The reform to the Labor Code regarding breastfeeding and breast milk expression was officially published through Legislative Decree No. 10895, in Item No. 41 to Official Gazette No. 74, dated Thursday, April 23, 2026.
As previously reported, this reform introduces specific obligations for employers, including:
- New time periods for the exercise of rights related to breastfeeding and breast milk expression, applicable to both ordinary and overtime working hours.
- The requirement to provide adequate spaces for breast milk expression.
- Adjustments to work shift organization.
As this law is now in effect, it is essential for organizations to:
- Assess facility compliance regarding the requirement to provide adequate spaces for breast milk expression.
- Review their internal policies and regulations.
- Adjust their operational practices to ensure regulatory compliance.
Employers are now subject to inspection and enforcement proceedings, and may be held liable for non-compliance. Therefore, it is recommended to take the necessary actions as soon as possible and to properly document any measures adopted.
