#ElSalvador 🇸🇻 #BDS_LaborAlert: Unauthorized Use of Databases May Lead to Prison Sentences of Up to 12 Years

The Committee on Salvadorans Abroad, Legislation, and Government of the Legislative Assembly unanimously approved a bill amending Articles 3 and 11 of the “Special Law Against Cybercrimes and Related Offenses.” This amendment imposes prison sentences on individuals who have access to customer databases and illegitimately use such data.

The amendment was endorsed by the Director of Investments of the Ministry of Economy, who explained that the aim is to enable "the company itself, as the custodian of its clients' data," to file complaints and take legal action. Currently, only the data owner has the right to file a complaint.

Under the amendment, the penalties are as follows:

A prison sentence of 10 to 12 years for individuals with "legitimate access" to databases, customer relationship management systems, blockchain services, subcontracting, or services involving the records or information of individuals, who illegitimately consult, extract, or use this information. 

The amendment is set to be approved by the Legislative Assembly during the plenary session on Tuesday, August 13, 2024.

This reform will enable employers to protect themselves against the misuse of databases by their employees who are responsible for them.
