The reform to Article 515 of the Labor Code, approved in October 2025, which authorizes new types of paid leave for employees, was published on Thursday, November 12, in the Official Gazette.
Previously, Article 515 only allowed paid leave when employees were required to appear as witnesses or to participate in a judicial proceeding. With this amendment, employers are now required to grant paid leave to employees who need to be absent to complete personal procedures before the Ministry of Labor and Social Security (MTSS) or to participate in disciplinary proceedings within the Public Administration.
Since these circumstances were not previously regulated in the Labor Code, they often raised questions as to whether employers were required to grant such leave. Now, employers must authorize it, provided that the employee presents the corresponding subpoena in advance and subsequently submits proof of attendance.
The reform was published under Law No. 10,771 and entered into force upon its publication in Item No. 146 of Official Gazette No. 213.
