The Costa Rican Social Security Fund (CCSS) has approved a key amendment to the Regulation on the Granting of Certified Medical Leaves and Statutory Leaves of Absence, intended to clarify which activities an insured person may or may not engage in while on certified medical leave or during a statutory leave of absence.
The amendment, unanimously approved by the Board of Directors on May 29, introduces specific changes to Article 14 of the Regulation and will come into effect upon its publication in the Official Gazette.
This regulatory change addresses the need to eliminate interpretation gaps and provide greater legal certainty for both workers and employers. Until now, the lack of clarity had led to uncertainty about the types of activities that could be carried out during a period of certified medical leave or statutory leave of absence without risking suspension of the leave payment.
Our firm will monitor the entry into force of this reform and will host a Webinar on June 26, 2025, specifically on this topic, in order to explain its practical application, clarify frequently asked questions regarding statutory leaves of absence and certified medical leaves, and analyze the labor law implications of this reform.
