In El Salvador, private workers and employers have the right to freely associate through unions or professional associations to defend their common economic and social interests.
As for unions, different types are recognized, including: professional unions, company unions, industry unions, those covering several companies, and independent workers unions.
Specifically, industry unions are defined as those “formed by employers or workers from companies engaged in the same industrial, commercial, service, social, activities and the like.” This means that individuals from different companies in the same industry can be part of the same union.
It should be noted that to form a union, at least 35 workers are required, followed by legal personality recognition from the Ministry of Labor and Social Security.
Employers must recognize unions that represent the interest of workers, as well as deal and collectively bargain with such unions when they represent the majority of their workers; although they may also do so voluntarily even if the union does not represent the majority.
Recently, the Ministry of Labor and Social Security granted legal personality to the Industry Union of Teleoperators of El Salvador (SITOES), a significant development considering the importance of the call center sector in the country's employment landscape.
It is crucial to note that not all union members are protected from disciplinary action, including dismissal—only those in the union’s Executive Board (a minimum of 3 and a maximum of 11 people) or, if applicable, as in the above referred unions, within the executive boards of company sections (with a minimum of 3 and a maximum of 7 members).
