This year, the enjoyment of the September 15th holiday - which commemorates Costa Rica’s 199 years of Independence - will be moved to Monday September 14.
This is one of the holidays that were moved according to Act 9875, which was recently enacted as a measure to promote domestic tourism in light of the effects of the national emergency caused by the pandemic. Specifically, this law adds a transitory provision to Article 148 of the Labor Code which moves the enjoyment of some holidays to Mondays during the 2020 – 2024 period.
Regardless of the nature of the specific organization, company or institution, this holiday must be enjoyed by any employees working in the country. September 15th, which enjoyment has been moved as indicated above, is considered a mandatory pay holiday. Therefore, if the employer requires its employees to work on this holiday, these workers must be paid double the ordinary rate for their work on that day. If they are also required to work overtime, any overtime worked must be paid time and a half the hourly rate of that day, i.e. in this case, double rate; as a result, said workers must be paid triple the ordinary hourly rate.
