#CostaRica 🇨🇷 #LaborAlertBDS: Approval of reduced work shift for the tourism and commercial sectors subject to limited capacity in the light of the declaration of national emergency

Congressmen approved in final stage file 22405 concerning the extension of the period during which reduced workshifts were authorized for the tourism and commercial sectors with limited capacity in the light of the declaration of national emergency.

The Ministry of Labor and Social Security, based on reasonable and well-supported grounds, may expand the list of activities mentioned in this transitory provision to cover other tourism-related activities being affected and requiring a reduced work shift.

In case this extension is authorized, the employer must refrain from:

1. Establishing fractioned working schedules for persons subject to reduced work shifts.

2. If the reduced work shift applies to a specific percentage of workers, no overtime may be paid to any workers remaining in the company but rather reinstate the person subject to reduced work shift where required.

Effective as from its publication.
