On March 5, 2025, the Legislative Assembly approved, in its second discussion, Bill No. 23.528, which amends the Law to Regulate Telework (Act No. 9.738) to incorporate the possibility of performing remote work from outside the national territory.
Key Amendments
The project amends Articles 2 and 10 of the law and introduces a new Article 11, establishing that telework abroad shall be voluntary; the employer must subscribe to extraterritorial coverage in workplace risk insurance policies; and this form of employment abroad must be formalized through an agreement between the parties.
Additionally, the bill sets forth the obligations for each party:
- If the employer requests or demands remote work abroad, they must provide the necessary tools and insurance coverage.
- If this modality is proposed by the employee, any costs related to equipment and extraterritorial occupational risk coverage must be borne, in whole or in part, by the employee.
Following its approval in the second discussion, the only remaining step for the law to enter into force is its publication in the Official Gazette, La Gaceta.
