#Honduras 🇭🇳 #BDS_LaborAlert: Labor Inspections Will Now Require Proof of RAP Contributions

The Ministry of Labor and Social Security of Honduras has begun requiring, within its investigative powers, the submission of payroll records evidencing contributions to the Private Contributions Regime (RAP).

Accordingly, during labor inspections, authorities may request proof of compliance with employer obligations related to affiliation with and contributions to RAP, as part of a comprehensive verification of compliance with labor and social security regulations.

Additionally, it must be reminded that RAP has established a grace period for companies that are not registered or have failed to comply with their obligations, allowing them to bring their status into compliance under special conditions, as previously noted in our prior alert.

In light of the above, we recommend that all companies:

  • Verify that they are properly registered with RAP.
  • Confirm that all eligible employees are duly registered.
  • Ensure that contribution payroll records are up to date and properly filed.
  • Take advantage of the current grace period to rectify any omissions or non-compliance.

Failure to comply with these obligations may result in findings, corrective actions, and even administrative fines imposed by the labor authority.
